Marriage of UK citizen to Mauritian national

I have got stuck in a loop.


I intend to get married to a Mauritian citizen in Mauritius but am getting some mixed messages from official channels.

I am informed from the British Government that marrying a Mauritian Citizen is relatively simple as you both live in a commonwealth country.

I contacted my local Marriage Registry Office and they basically told me we don't need to provide a Certificate of Non Impediment (CNI) for people getting married in commonwealth countries.


The Mauritian government however require you to have a CNI or notarised letter stating you are not married. This seams a bit odd as its up to the proposer (the intended) to prove that they are not married, and since we don't have a ID card or any public/police involvement in government affairs concerning the citizen here, its practically impossible to prove your marital status if you are not married, as there are no official documents stating it.


Is there anyway out

@commucomp , thank you for bringing up this planning question.


I am a Mauritian and married a non-Mauritian spouse a while back. I did not do any of the steps that you are planning on doing and followed the romantic path and got all the paperwork outside of Mauritius. According to the published citizenship documentation -> there does not appear to be consequences for not following the path that you are stuck in a loop.


I may be totally guessing here but that the intent of the CNI request is not to prove the single status but rather to detect that someone is already married as polygamy is probably not legal in Mauritius.


I am not a lawyer nor am I offering any legal advice here but if you are 100% certain that your future spouse is still single, this should not prevent your marriage in UK or Mauritius - the paperwork can be done where / when you can get it done. Getting and staying married is such a life changing event. The time before getting married should not be stressful but rather an enjoyable period.


If I am getting this all wrong, I am willing to be corrected.
