Sorry for not being clear.
When I got my my orange card 4.5 years ago my husband was non Belgian. Since he was here before me, he became Belgian last year.
I am trying to figure out whether the condition of the 6 months of orange card counting towards my 5 year period of residence still applies even if he is now a Belgian national.

@QGH 931 The orange card should be counted in either case. For the partner of a Belgian, there are many appeal cases that won in the end, and the Belgian constitutional court ruled in 2021 that the current law violates the constitution:https://www.stradalex.com/fr/sl_src_publ_jur_be/document/cconst_2021-77I successfully received the citizenship this year with the period of the orange card counted as legal stay, although I'm not sure if my file was really reviewed (it seems that some files are just passed without being reviewed). If you want to be 100% sure, then maybe you can simply apply for the citizenship when you have your F card for five years. But if you want to apply now, I think adding a letter to your application files listing the previous court cases and the constitutional court's ruling would be strong enough to convince them that the law is flawed.The city hall might give you better advice regarding if you should be considered as a partner of a Belgian or an EU citizen for the application

so it means you got orange card then an A card.
and then your husband became Belgian.m, you got F card. Am I correct with this timeline?

Hello all. So just to be 100% sure, prosecutor office can only refuse belgian nationality application within 4 months from date of application of nationality (date of issue of accuse de reception) ? And he cannot/have no authority to give a negative opinion after this time period of 4 months?
@ABS25 indeed, but if they tend to refuse, they usually do it after 1-2 months and do not wait until 4.
Only in some exceptional cases where its too complex and requires the involvement of multiple parties then you may hear negative in the 4th month.

No, not nationality.
My first application for card F due to income statement not being in order.
After wards my partner contacted her HR and a new contract that indicated but brutto and netto was given to her. We then used the new contract to apply the second time, and it was approved and card F issued.

When I first applied for card F, my girlfriend submitted her work contract and payslips. On her work contract what was indicated was the gross salary. The application was denied reason being that the net salary was not indicated in the contract.
I had to apply again (she requested from her HR a new contract that indicated both the gross and net salary) and with this the card F was approved.
Personally I thought it was just a flimsy excuse for us to appeal so that they could tie up the case as long as they wanted. But we just accepted their decision then and applied again the following week.

Can I apply for Belgian citizenship without waiting for physical permanent residency card to arrive but just with the paper that is stating me waiting for L card to arrive? I want to gain some time by making an appointment of citizenship application at commune at the day when my L card application reaches to 5 months of duration.
What do you think? Can I at least start the process? Will they still ask for the physical card anyhow you think?

From what you mention you have only applied for your L card right?
I hope you are updated with the information that the L card is no longer auto approved after 5 months?.
I believe since mid/end May 2023 you need to wait for the approval from the ministry even if you crossed the 5 month period.
But yes, you can already take an appointment with the city hall for your nationality to save time and hope that your L card is approved in the 5 month period.

You can ask for appointment and luckily if you will have your physical card on hand at that appointment then it will be good to go.
Technically speaking, its likely they will not consider your application when you have no valid eID card. It does not say that you can just apply with an Annex as an eID is created will have it’s certificates and unique card number attached to it.
The best guy to answer you is the Nationality office at your commune because per law, they require a valid eID on hand. But depending on the commune, maybe the person will charge it slightly different. But I am doubting who will do it…

@Peterjohn123 I am actually also very much curious to know where this information is coming from. In this forum 2 profiles mentioned in other threads this so called new regulation and made everyone scared including myself. I know at least one person who felt like they have to check in with commune after reading these statements in this forum. My commune and my friend's commune told us recently (information provided to my friend 1 week ago and to myself 2 days ago and we both have different communes in Flanders) that our L card will be issued automatically. I hope information coming directly from our communes are righteous...
@Peterjohn123 It was informed by the commune when my colleague went to get his L card.
He got his L card this week after 7 months. (I got the same information from 3 other colleagues who applied for the L card). (perhaps it could be due to the holiday period, so lets hope that its approved in 5 months).
Also not all members in the commune are sure on the procedure.
They also did inform that it should be approved in 5 months, but then they always call the ministry to confirm and then they get a response to wait.
@mjzk I hope the same for everyone applying for the L card that it is issued in 5months.

I am only giving the inputs I receive from my colleagues as I am a mediator in my organization for international colleagues.
if your city hall mention that you will get it in 5 months, then lets go with that information.
@mjzk I am not sure that just starting the file will save you time.
the application is only sent ahead once all your documents are submitted.
When I applied, the first document they asked was my Permanent residence document.
They also verified it on the system before starting my file.
But if the person who handles your file is willing to start it, then all the better.

@eshwarraj09 Its not about hurrying, its about efficiency. I have a busy life and if I can decrease my amount of visiting commune, I would prefer to do that.
@mjzk then the best option is to prepare and keep your file ready. When you get your L card, apply for your nationality immediately.
Do you have all the documents in the correct format? meaning translated birth certificate/apostiled, nationality payment from minfin and all the others? if yes, then you are on the right track... once you get your L card PPROVAL,apply in fasttrack to get it and immediately apply for your nationality.
But from which commune are you registered. because everyone have different way of working. I believe in Antwerp everything is done via email. In Gent we need to visit in person each time and so on...

If I understand correctly from you that you would like the nationality official to check all your files and make sure they are in order and when you have a valid eID, you will submit everything, is that correct?
To be honest, I am always asked to have all files ready before they could start the review (review, not submission).
So I am not really sure if they would do anything if you do not have everything ready. But its worth to ask them if they could help. Maybe they can as it depends on the commune ac

@BMM996210 Every commune is different. Even clerks working in the communes sometimes don't agree on procedures. This is my conclusion from my long journey of applying for four single permits and one permanent residency in the last 5.5 years.
According to my commune and my experience, I was able to get my L card one day after five months had passed.
I was not able to apply for citizenship with Annex 15. Even though some clerks told me that I could apply if the card number were written on Annex 15, my file was complete and only missing my ID photocopy. The person receiving my application asked me to wait for the printing of the ID. I had a thorough check on my file even without having a valid ID. So, based on my experience, they do not refuse to check your nationality application file when you don't have a valid ID.

l have applied my nationality on 02 Augest 2023.
After one month and one week area police came to my address and it was normal check up and not more than 5 mins, the police said he has been sent by Brussels to come and verify my address and that l have applied for Belgium Nationality, that is all. The police said everything is alright so l should wait for decision letter from Brussel.
Today 17 September 2023 l received a letter by post that my nationality has been approved so l should make an appointment from the commune to change my ID card.

But you can make your declaration for nationality in any commune or you can do it personally online but the invitation comes from Deurne commune that is what I was told.
